Defining elements

The following general terms and conditions will apply to all sales of goods and services by Mosaic Project SRL, through the online store www.agrodot.ro to the buyer.

Thus, the following terms are defined as follows:
goods and services: any product or service to be provided by the seller to the buyer;
order: an electronic document through which the buyer requests the purchase of goods or services presented in the offer of the online store www.agrodot.ro;
contract: the order confirmed by the seller (confirmation of an order can only be made by phone or electronically).

Registration and order confirmation

2.1. By placing an order (electronically or by phone) through the online store www.agrodot.ro, the buyer agrees to the form of communication through which the seller conducts its operations (electronically or by phone).

2.2. An order consists of the following:

  • goods or services found in the offer of the aforementioned online store;
  • clear mentions regarding billing, delivery information, and other special notes;
  • the buyer’s specifications.

2.3. Placing an order (electronically or by phone) does not imply confirmation of the order and the contract. The complete steps are as follows:

  • Order registration: A unique number is automatically generated for each registered order;
  • Order processing by a sales agent, within the working hours displayed on the website in the Contact section (the Sales Department’s schedule);
  • Order confirmation is made after verifying the order and the stock of the products in the order. This confirmation is made only by a sales agent, either by phone or electronically (email);
  • Order delivery is made after the order has been confirmed and the delivery details have been established by the sales or delivery agent and the buyer.

2.4. The products available in the online store www.agrodot.ro can only be sold based on an order. The order will be processed according to the steps mentioned above during the Sales Department’s working hours. An unconfirmed order does not imply a reservation of the products. Orders will be fulfilled in the chronological order in which they were registered in the database. An order containing products displayed on the site with the following status: IN STOCK, SUPPLIER STOCK (WAREHOUSE), or MADE TO ORDER cannot be fulfilled if another order for the same product was registered before it in chronological order and subsequently confirmed, thus depleting the stock.

Prices and stock of products

3.1. The prices and stock of the products are updated at intervals ranging from 24 hours to 5 days. Prices in orders and proforma invoices are valid for 3 days from the date of issuance.

3.2. For products ordered through special requests, a deposit of at least 30% of the product’s value may be required.

3.3. If prices or other details related to products are displayed incorrectly, including due to errors in the database, we reserve the right to CANCEL orders containing these products and notify customers as soon as possible about the error.

3.4. The stock of products sold by the online store www.agrodot.ro is indicated as follows:

  • IN STOCK: The product is physically in stock and can be picked up/delivered based on an online order, AFTER ORDER CONFIRMATION. Orders for products with the status IN STOCK will be fulfilled in the chronological order in which they are registered in the database. All products displayed with the IN STOCK status have a limited number of units. Stock updates are done as mentioned above, so there may be situations where a product ordered with the IN STOCK status becomes unavailable if it has been confirmed for a previous order.
  • SUPPLIER STOCK: The product is in the supplier’s offer and theoretically in their stock. Stock verification at the supplier is carried out by a sales agent within a maximum of 48 working hours after the order is processed. Given that supplier stock updates are not done in a timely manner to provide exact information, there may be cases where a product displayed as available in supplier stock is actually out of stock. Additionally, these products may only be available through special orders, with delivery times ranging from 2 to 30 days. Since the information comes from the supplier, we do not take responsibility if the product is not actually available in their stock.
  • MADE TO ORDER: The product requires manual stock verification; it is still offered by suppliers but can be brought in through special orders from the manufacturer with delivery times ranging from 15 to 60 days (delivery time confirmation is provided by the supplier) or may even be out of stock with an indefinite restocking time. Stock verification with the supplier is carried out within a maximum of 5 working days after the order is processed.
  • UNAVAILABLE: The product is no longer available in either the www.agrodot.ro stock or the supplier’s stock. This information is displayed for products that were in stock but are no longer available until they are removed from all offers of suppliers that www.agrodot.ro collaborates with.

Product delivery

4.1. Products ordered from our website are delivered only within Romania, throughout the country, via private courier companies, Urgent Cargus or Fan Curier Express.

4.2. Product delivery can occur within a minimum of 24 hours and a maximum of 30 days from the moment all order details (payment method, delivery time, stock, prices) have been validated and/or from the moment payment has been made – in the case of advance payment (Bank Transfer, card payment, deposit).

4.3. Orders with a value greater than 500 lei benefit from free delivery. The delivery fee for orders with a value less than 500 lei is 20 lei (the value may vary depending on the weight of the package and the distance).

4.4. The usual delivery time for products purchased from our online store is 3-15 days from the moment the order is registered. In special conditions, Mosaic Project SRL reserves the right to extend the delivery time, with prior notification to the person who placed the order.

4.5. All products are accompanied by a warranty certificate. The fiscal invoice will be issued on paper.

4.6. Mosaic Project SRL reserves the right to delay or cancel the delivery of ordered products if they cannot be fulfilled for reasons beyond its control, including: fires, explosions, floods, epidemics, strikes, government actions, wars, acts of terrorism, protests, riots, civil disturbances, or other force majeure impediments in accordance with Romanian law.

4.7. The maximum amount of damages that Mosaic Project SRL may pay to any client in the event of non-delivery or improper delivery is the amount received by Mosaic Project SRL from that client.

4.8. In the case of express courier deliveries, it is recommended that upon receiving the order, the product(s) be checked for any physical defects caused by transportation. Additionally, it is advisable to verify the product in terms of specifications, accessories included, and functionality. In the event of any discrepancies or deficiencies, the procedures outlined below should be followed. It is recommended that the inspection be conducted immediately after receiving the order, and any claims should be made within a maximum of 48 hours from receipt, to the email address: sales@agrodot.ro. The claim must contain information about the order, the condition of the product, and preferably some photos of the product/package with issues.

  • This timeframe also applies to orders picked up from the showroom where the products were not tested at the testing bench.

4.9. When placing an online order, the Client declares that they have read and fully agree with the above statements.

Copyrights

5.1. Copyrights for the entire content belong exclusively to Mosaic Project SRL and cannot be used or copied without the written consent of the owner.

5.2. Those who access this website have the following rights:

  • To explore the content of www.agrodot.ro
  • To reproduce, translate, or use the published information only with the source’s consent;
  • To insert links to this website on their own pages (when links are included in commercial or advertising websites, a new window must be opened for viewing the site www.agrodot.ro);
  • A person who bases their decisions, actions, or inaction on the information contained in this website assumes full responsibility for any losses incurred.

5.3. The photographs presented are for informational purposes and may contain accessories that are not included in the product’s standard package.

5.4. Technical specifications are for informational purposes, may change without prior notice, and do not constitute a contractual obligation.

Limitation of liability of Mosaic Project SRL

8.1. Responsibility for the content of the SITE. Mosaic Project S.R.L. is not and cannot be held responsible for damages caused by errors, inaccuracies, or the lack of updates to the information published or maintained on the SITE, which are not due to its fault.

8.2. In the case of system errors that clearly alter the price, the order will be canceled, and customers will be informed by phone/email of this fact.

8.3. The characteristics of the products presented on the SITE are obtained/provided by manufacturers and/or suppliers, and Mosaic Project S.R.L. does not assume responsibility for the accuracy of this information.

8.4. The prices of products on this SITE are informative and may change without notice. Promotions presented on the SITE are valid for the mentioned period; if no time period is specified, they are valid within the limits of available stock. The prices displayed on the SITE may differ from those in our physical store, and discrepancies may arise between the price of the product displayed on the SITE and the price displayed in the store. Orders for products with prices lower than those displayed in the store will remain valid and will be fulfilled in the order in which they were registered on the SITE and depending on the available stock limit for each product in the order. All products presented on this SITE are available within the limits of the available physical stock. In case of stock depletion, the representative of Agrodot.ro will offer alternatives by presenting other products similar in appearance and technical specifications to the ordered product whose stock has been exhausted.

8.5. Additionally, images are presented on the SITE for example purposes, and the delivered products may differ from the images in any way due to changes in characteristics or design made by manufacturers without prior notice.

8.6. Mosaic Project S.R.L. reserves the right to complete and modify any information on the SITE.

8.7. Any issues caused by the products and/or services presented on the SITE will be resolved amicably within 15 working days from the date of written notification of the issues by the USER.

8.8. Mosaic Project S.R.L. is not liable for any losses, costs, lawsuits, claims, expenses, or other liabilities if these are directly caused by non-compliance with the Terms and Conditions.

8.9. Mosaic Project S.R.L. is not responsible for damages resulting from the malfunctioning of the Site as well as for those arising from the inability to access certain links published on the Site.

9.1 Neither party shall be liable for failure to fulfill its contractual obligations if such failure is due to force majeure. Force majeure is an unforeseeable event beyond the control of the parties which cannot be avoided.

9.2. The terms and conditions of sale of products on the Agrodot.ro website may be amended by consensus of the management of the company operating the website. The proposed changes will be communicated in advance to all members of the management.

9.3 The Terms of Use recorded in this document come into force as of March 1, 2018.

9.4. The Terms of Use published on the www.agrodot.ro website, as well as the procedure for resolving complaints from end-consumers, may be accessed at any time by the Client, consulted and printed; they are electronically archived by Agrodot and are proof of the legal relationship between the parties.
